L.Knighton provides you access to the LKnighton.com website in order to help you at every stage of the recruitment process and offer you other specialist services. Please read these Terms of Use carefully before using the website. Using the site indicates that you accept these Terms of Use.

Where L.Knighton introduces by telephone, postal mail or electronic mail any candidate for an employment opportunity with our hiring clients the introductions shall be subject to our standard Terms of Business as applicable. We will provide all of our hiring clients with a copy of the standard Terms of Business applicable to them at the point of registration or following registration. These Terms of Use are in addition to and not in substitution for our standard Terms of Business.

YOUR USE OF THIS SITE

You may access most areas of the site without registering your details with us.

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You will not use the site for any of the following purposes:

  • To post or transmit any material for which you have not obtained all necessary licences and/or approvals

  • To post or transmit on the site inaccurate, incomplete or false information (including in the case of candidates, biographical information about yourself and/or information about your ability to work in the relevant country of employment)

  • To post or transmit on the site any libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material

  • To post or transmit on the site any material which contains any viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or which interferes or may interfere with the operation of the Site; or which alters or deletes any information which you have no authority to alter or delete; or which overloads the Site by spamming or flooding it.

  • To use any device, routine or software to crash, delay, or otherwise damage the operation of this Site

  • To take any action that affects L.Knighton’s reputation or that defames, abuses, harasses or threatens others

  • To encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law; or carry out such conduct yourself

You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990 (or equivalent legislation). We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

L.Knighton in its sole discretion shall determine your compliance with the above and shall have the right to prevent you from using the site and/or to delete from the site immediately and without prior notice any material that it deems not to comply or to be objectionable for any reason. L.Knighton shall co-operate fully with any law enforcement authorities or court order requesting or directing L.Knighton to disclose the identity or locate anyone posting any material in breach of the above. As the services on the site are made available to users and employers immediately, you do not enjoy any cancellation or “cooling-off” rights in relation to these Terms of Use.

You agree fully to indemnify us and keep us fully indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of this Site

LINKS TO OR FROM OTHER WEBSITES

As a convenience to users, this site may contain links to external websites and you may be offered a number of automatic links to other sites, which may interest you. We accept no responsibility for or liability in respect of the content of those third party sites. L.Knighton have not reviewed or approved such sites and does not control and is not responsible for those sites or their content. L.Knighton does not warrant that any links to such sites work or are up to date. L.Knighton do not endorse or make any representations about those sites and the use of any such links is entirely at your own risk.

Any third parties wishing to link to our site may do so provided links are to the home page only of the site and provided we are notified in advance by email to contact@lknighton.com and that it is done in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our site in any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our Site other than the home page

L.Knighton reserves the right to refuse to allow third parties to link to our site and shall not be required to give any explanation for such refusal, or for withdrawal of previously granted permission.

PERSONAL INFORMATION

We may gather information and statistics collectively about all visitors to this site which may include the information supplied by you which will help us to understand our users thereby creating a better recruitment process. We will not disclose individual names or identifying information without prior notification. We believe this information helps us determine what is most beneficial for our users and how we can continually improve our online service. We may share data with selected third parties to assist with these purposes. Personal data is processed by us in accordance with our Privacy Policy

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, the copyright and other intellectual property rights in all material on this site (including without limitation photographs and graphical images) are owned by L.Knighton or its licensors. You may not download copy or print any of the pages of the site except for your own personal use, and provided you keep intact all copyright and proprietary notices. No copying or distribution for any business or commercial use is allowed. No framing, harvesting, “scraping” or other manipulation of the content of the site is permitted. You will not attempt to decipher, disassemble, reverse engineer or modify any of the software, coding or information comprised in the site; nor will you post to the site any material which infringes any intellectual property rights of any third party.

CHANGES TO OR TEMPORARY UNAVAILABILITY OF THIS SITE

Every effort is made to keep the site up and running smoothly and fault-free. However, L.Knighton takes no responsibility for, and will not be liable for, the site being temporarily unavailable for reasons of maintenance/improvement, or due to technical issues beyond our control. We may change, suspend or discontinue any aspect of the Site at any time, including the availability of any of the site features, databases or content. We will try to give you reasonable notice of any suspension or withdrawal. L.Knighton may amend these Terms of Use at any time by posting amended Terms of Use to the Site. You will be deemed to have agreed to the amended Terms of Use when you next use this site following any amendment.

Our website may contain links to enable you to visit other websites of interest easily. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

We may at our absolute discretion deny you access to this Site (which may include any of the services or information available through it) or any part of it at any time without explanation.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

If you are an employer:

We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

a) use of, or inability to use, our Site; or

b) use of or reliance on any content displayed on our Site.

In particular, we will not be liable for:

If you are a candidate:

Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not guarantee that any employer or client will ask for a candidate’s information, or will interview or hire a candidate, or that any candidates will be available or will meet the needs of any employer or client. We make no representation or warranty as to the final terms and duration of any appointment obtained through this site. Whilst we take all reasonable endeavours to ensure it is the case, we do not guarantee that any employer or client will keep confidential any candidate information or data provided to them.

If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidly shall not affect the validly of the remaining provisions, which shall remain in full force and effect. Your use of the site and downloads from it, and the operation of these terms and conditions, shall be governed in accordance with the laws of England and Wales. The English courts shall have exclusive jurisdiction over any dispute arising out of the use of this site.

DATA PROTECTION and PRIVACY POLICY

L.Knighton Limited is committed to protecting the privacy of our users. We want to provide a safe and secure user experience, thus we have procedures and security features in place to keep your data secure and private once we receive it.

The information we collect and how we use it:

Your personal details, including your CV, are held and used by us for the following purposes:

  • For advising you on your career options, matching your details with job vacancies, to assist us in finding you the position that most suits you;

  • For assessing your profile against job vacancies for which you have applied;

  • For keeping you informed of L.Knighton services and wider news/events;

  • For compiling salary and other surveys of our candidates.

For an exhaustive list of the information we collect and hold, how and why we do so, how we use it and with whom it may be shared, you can contact legal@lknighton.com.

We may also need to share some of the categories of personal information set out with other parties, such as external contractors and our professional advisers. In most cases, information is only shared for the delivery of our service to you or to comply with our legal obligations.

We seek to ensure that our information collection and processing is always proportionate. We will notify you of any changes to information we collect or to the purposes for which we collect and process it.

Where information may be held:

Information may be held at our offices and those of our group companies, and third-party agencies, service providers, representatives and agents as described above. Information may be transferred internationally to other countries around the world, including countries that do not have data protection laws equivalent to those in the UK, for the reasons described above. We have security measures in place to seek to ensure that there is appropriate security for information we hold.

Disclosures of your information:

We will share your information within L.Knighton where necessary in order to provide you with our recruitment services. We will also share your details with prospective employers when you have applied to a job vacancy relating to that prospective employer.

L.Knighton engages the services of third-party service providers (Data Processors) in order to manage day to day business affairs, including but not limited to the sending emails and storage of data. Personally identifiable information will be contained within these solutions and a complete list of these providers is available upon request by emailing legal@lknighton.com. L.Knighton and our data processors are bound by GDPR compliant contractual agreements in order to ensure the protection and correct handling of your personal information.

We may share your information with third-party clients for the purposes of sourcing recruitment opportunities.

We may pass on your personal information if we have a legal obligation to do so. We also reserve the right to disclose the information we have collected about you to our professional advisors and to other persons to the extent that L.Knighton contracts out any aspect of the operation of its recruitment agency services.  These third parties will be acting under similar undertakings of confidentiality as L.Knighton.

How long we keep your information:

The period for which we keep your information is dependent on whether or not we have placed you in a temporary or permanent booking.

Where we have been unsuccessful in placing you in a temporary or permanent booking, we will retain your data for 6 years from the date we last contacted you in our database and for 6 months if there has been no further contact after your initial application. If we have placed you, we will retain your information for 6 years from the date of placement or date on which you last worked for us.

We will retain certain pay-related and other financial information for 6 years in order to comply with our legal obligations.

Retention of data:

Retained data is reviewed every 6 months to establish its age and when data is no longer required or has reached its maximum time limit, it will be appropriately destroyed. If you believe we are in possession of personal data that you wish us to delete prior to these pre-determined times, please contact our Data Compliance Representative at legal@lknighton.com to request deletion.

Keeping your personal information secure:

We have appropriate security measures in place to prevent personal information from being accidentally lost, or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.

We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

Data portability:

GDPR pertains to certain requirements on data controllers for the portability of personal data. The data stored on our database is controlled by the Company. L.Knighton permits the portability of data on mobile devices such as mobiles or laptops, as well as advocating home working, under restriction and/or limitations. This is also for the benefit of data subjects. Access to this data can be terminated or limited as and when necessary to prevent data breaches or leaks. Every reasonable step is taken to ensure that L.Knighton data accessed outside of our network is secure.

Reporting data breaches:

As per the GDPR guidelines we would analyse any suspected data breach and report it within 72 hours of becoming aware of the breach. Unless the breach itself is considered low risk, breaches would be reported to the top authorities, which would be the ICO (Information Commissioner’s Office). Once a data breach or leak has been detected then it would be reported to this authority. A data break or leak includes but is not limited to: a lost USB stick, loss or theft of portable devices, or data sent to the wrong person. We have processes and policies in place to avoid any potential data breaches. We train all of our staff on the importance of data security and what their responsibilities are with safeguarding data that L.Knighton processes.

Internal policies for GDPR:

L.Knighton executes a stringent security and access policy for employees that safeguards data and protects the integrity of data. L.Knighton also ensures this doesn’t impact business functions and data subject or data subject experiences. We have a data security policy, confidentiality policy, password policy and a policy to target Bring Your Own Devices (BYOD). These policies aim to mitigate any instance of data breach or leaks and employees are trained in maintaining data security.

IT policies for GDPR:

L.Knighton outsources its IT system maintenance and management to a Third-Party. This Third-Party supplier is responsible for safeguarding the network and terminals with access to the network. They manage the anti-virus on the machines, encryption and security updates to mitigate against data breaches and leaks. The data this Third Party can access is limited to the minimum needed to complete their role and they are also bound by a data privacy and confidentiality contract. L.Knighton is solely responsible for employee accessibility in granting, limiting or terminating accessibility where necessary.

YOUR RIGHTS

You have the right at any time to ask us for a copy of the information supplied by you that we hold. If you would like to make a request for information, please contact legal@lknighton.com. You also have the right to ask L.Knighton to stop using your information, amend it or erase it.
